& Conditions The use of the Fiesta.co.za website is subject to these Terms
and Conditions. Checking the box alongside "I have read and agree to the
Fiesta.co.za (Ntando Investments 13 CC) Terms & Conditions" on the
Registration Form is an indication of a user's acceptance of these Terms &
Conditions. Registration with Fiesta.co.za is open to anybody. Eligibility
for specific services, promotions or competitions may vary. No purchase is necessary to register with Fiesta.co.za. Distribution of Photographic
Material The website provides a service whereby Fiesta.co.za users can
email photographs to other people. Notwithstanding this service, Fiesta.co.za
specifically retains ownership and copyright to each and every image and their
distribution, reproduction, publication, adaptation, sale, either in part or
whole, online, in print, or any cinematograph film, video film or television
broadcast, requires the prior written permission of Fiesta.co.za. By making
these images available to its users Fiesta.co.za is in no way whatsoever
assigning its rights, title and interest including copyright to the images
throughout the world and in perpetuity. Competition eligibility 1.
Promotions are only open to Fiesta.co.za
registrants. 2.
Employees of Fiesta.co.za, its advertising
and promotions' agencies and immediate families are not eligible for entry into
competitions. 3.
Certain competitions may only be open to
legal South African residents, over the age of eighteen. Competition Rules 1.
Entries to all competitions hosted on this
website are subject to these Terms and Conditions, the Privacy Policy and the
Rules of each competition. 2.
Fiesta.co.za registrants are only permitted
to submit one entry per competition. 3.
Entries submitted through the use of macros,
scripts or any automated means are ineligible. 4.
Competition entrants may be provided with
the opportunity to increase their chances of winning through referring other
eligible persons to a specific competition. 5.
Competition entries are logged when they are
received by Fiesta.co.za and not when they are sent by entrants. 6.
Fiesta.co.za does not bear responsibility
for entries lost through negligence, mistakes, omissions, interruptions,
deletion of files, errors, defects, delays in operation or transmission or any
failure of performance, whether or not limited to Acts of God, communication
failure, theft, destruction or unauthorised access to our host's records,
programmes or services. 7.
Competition entries must be received within
the specified dates and times. 8.
Specified dates and times are subject to
change at Fiesta.co.za's discretion. 9.
The judges' decision is final and no
correspondence will be entered into. Drawing 1.
All entries with the correct answer(s) to
the competitions' qualifying question(s) will be included in the draw. 2.
Additional entries, accrued through
successful referrals to competitions, will be included in the draw. 3.
The draw is made randomly from all correct
entries. 4.
For competitions that accept postal and
internet entries, prize-winners will be selected randomly from a pooling of all
entries. Notification 1.
Prize-winners will be notified by email or
telephone. In the event of email being undeliverable to the address recorded in
the Registration Form or an email being unanswered, Fiesta.co.za reserves the
right to draw other prize-winners once reasonable attempts to contact the
prize-winners have been made. Fiesta.co.za Registrants are therefore required
to make sure that the email address and telephone numbers in the Fiesta.co.za
Registration Form are current. 2.
Prize-winners may be posted on the
Fiesta.co.za website. 3.
Upon notification, prize-winners may be
required to sign an affidavit confirming their personal information. 4.
Entry into a competition confers upon
Fiesta.co.za, its clients and/or appointed agents, permission to use the
winner's name, likeness and voice for purposes of promotion or publicity
without additional compensation. 5.
Winners for a specific competition can also
be requested by sending a self-addressed and stamped envelope to Fiesta.co.za, Limitation of Liability
& Disclaimer Although Fiesta.co.za endeavours to provide accurate, up to date
and truthful information on this website, neither Fiesta.co.za nor any of its
employees, agents and associates make any representations or give any
warranties, whether expressly, tacitly or implied, as to the operation of this
website or the photographs, information, content, materials and products
included and/or available from this website. Fiesta.co.za, its employees, agents and associates will not be
liable for any damage of whatsoever nature arising or resulting from the use of
or inability to use this website, the information, photographs, advertising or
content thereon and the prizes, including but not limited to direct, indirect,
incidental, punitive and consequential damage and refusal or inability of the
Competition Sponsor to deliver the prizes, as detailed on the website, to the
prize-winners. Editorial Control This website contains content provided by third parties and
hyperlinks to other websites. Fiesta.co.za does not screen or filter such
content on these websites or information available from other websites and
therefore does not accept any liability for defamatory, illegal or criminal content
contained on those sites. We encourage our users to report any infringement,
illegal or criminal content found on any of the websites available through
links from this website in order to investigate whether such links should be
removed. The website contains photographs taken by photographers
contracted by Fiesta.co.za. Fiesta.co.za endeavours to screen photographic
material appearing on the website. Any offending photographic material will
